In response to a very conservative State of The Union address, San Francisco Mayor Gavin Newsome gives the directive to issue same sex marriage licenses. This would be seen by many as the spark that lit a fire under conservatives right across the nation. Poor old Gavin just wanted to do the right thing by his constituents.

Out in space the largest diamond ever discovered was spotted by the Harvard Smithsonian Centre for Astrophysics telescope some 50 light years away from Earth. A white dwarf star named Lucy had fizzled out only to become 5 billion, trillion pounds of diamond!

Welcome to another episode of T -. 20 of the podcast where we rewind to this week, 20 years ago, all the way back to the year 2004 with your host Joe and Mel. 

Hello, Mel. Hello. This week, 20 years ago, would have been the week starting the 8th right through to the 14th. 

Of February. 

I believe we should respect individuals as we take a principled stand for one of the most fundamental, enduring institutions of our civilization. 

The most fundamental, enduring institutions of our civilization I'm making. 

Words ohh things are getting serious. 

Yes, with fundamental institutions of our civilisation, we're talking about marriage. 

And George W. 

With George W Bush and the institution thereof, and people who perhaps have been married for a significant amount of time, probably feel like they are in an institution anyway. 

After the discovery in 2004, astronomers decided to nickname the Space Diamond Lucy. 

Yes, Lucy, the space diamond lookout. That's a big, big, big diamond out in the middle of. 

We're like that. 

Case that we're going to discuss that was discovered. 

This time 20 years ago, yeah.

One word to it. We're gonna talk about it. OK, sure thing. Yeah, by Usher was released this time 20 years ago. And interestingly, usher is. Now main event at the Super Bowl halftime show and as part of recording. I've got no idea who's gonna be in the Super Bowl, but the Super Bowl is. 

20 years comes back around. What's your? What's your guess? 

Well, my hope is that it's gonna be San Francisco and Baltimore, right? It's gonna be San Francisco 49ers in Baltimore. And there's interesting things happening in San Francisco this time 20 years ago, which we hinted that earlier as well. And of course, usher at the halftime show. But who knows? It could be Detroit. Baltimore. It could be Kansas City, Detroit. We just. 

Well, now you've got your guests on. 

We'll never know.

Well, that's my hope against all hope. So I'm hoping that San Francisco can make it 6 Super Bowls in a row. I I have the day off work. I will be at home. The phone will be off, no interruptions. First beer will probably be consumed at about 10:00 AM. See the last one at probably about two or three. Yes, it's gonna be a horrible, horrible day. Really. It's a bad time. the Super Bowl in Australia. Because you do have to basically celebrate sport. At a very early hour of the day, and I just that's that's difficult. That's not you can't drink, you really can't. You just gotta, you know, have some mountain. 

It doesn't work well. No, I think.

I live for the ads. I love the Super Bowl commercials. That's the most exciting part for me. But I've felt over the last few years, I think coming out of. Covered. They've played it pretty safe. It's been pretty tame. I haven't seen anything where I'm completely blown away. There's been a few I've gone on there. Yeah, that's alright. So I'm hoping for some good commercials this year. 

Yeah, well. 

Well, coming out of ****** gate all the half time Entertainment's been pretty tamed since then as well. So maybe usher or mix things up, maybe he'll flash his ***** at people. 

Ohh, look out, maybe you'll have a a. What? What was it called? A shield. ****** Shields. I think it was a ****** Shields. 

I don't know it. 

Was it a ****** shield? Isn't that interesting? What would you? What would you want? To shield your ******* for? Just in case. Like you're at like a you know you're at Mother's Group, for example, and all of a sudden there's some rampaging baby that just can't get enough. And and it's like, thank God I'm all my ****** shield. Otherwise I'd be feeding somebody else's child.

Kicking things off with the news, as we always do, we'll start with the 12th of February 2004 and the City of San Francisco, CA begins issuing marriage licences to same sex couples in response to a directive. From the mayor at the time, Gavin. 

Newsom, which is why they deserve to win the Super Bowl this year. 

What triggered it is. What I love, so a couple of. Weeks ago and we. Forgot to cover this. It's just because. It's boring state of the Union address. 

Ohh, the state of the Union address. So they just go on and on and on. 

It's very long. There's lots of PowerPoint presentations goes for about an. 

Affirmation approvals applauding lots of sound bites. It's a sound bite fest. 

Hour and something we probably. It is. We probably should have covered it, cause I'm sure there was some interesting things in there, but we did. But at said state of the Union address, President George W Bush spoke out against activist judges who were redefining marriage by court. 

Order and it just so happens that we have the sound bites. 

I believe we should respect individuals as we take a principled stand for one of the most fundamental, enduring institutions of our civilization. Congress has already taken a stand on this issue. By passing the defence of Marriage Act signed in 1996 by President Clinton. That statute protects marriage under. The law. As a Union of a man and a woman, and declares that one state may not redefine marriage for other states. Activist judges, however, have begun redefining marriage by court order without regard for the will of the people and their elected representatives. On an issue of such great consequence, the people's voice must be heard. If judges insist on forcing their arbitrary will upon the people, the only alternative left to the people would be the constitutional process. Our nation must defend the sanctity of marriage. 

Yeah, so keywords to take away from that marriage and man and woman. From George W's. 

Protecting this sanctity of marriage? 

Between a man and a woman. 

And how dare these activist judges redefine what marriage means? Nationally, the issue of same sex marriage was gaining prominence. I think there was a court case in Massachusetts, which was basically laying the groundwork to force that state to legally recognise same sex marriage and as part of that address, Bush was acknowledging that and threatened. To back a constitutional amendment. To create that definition of marriage as between a man and. A woman who smokes to that. 

Because you know you if you go down to the southern states or you look like Westboro Baptist Church and plays, God created Adam and Eve, not Adam and Steve. Yeah, it's all of that sort of rhetoric being spouted and spewed forth. 

So mayor of San Francisco, Gavin Newsom listened to the address. He was, in fact, a guest. Of Nancy Pelosi. 

You know, he was he was triggered, is what he was. 

It was Nancy. 'S plus one, because I think her husband couldn't. Make it for. 

That's right, yeah. 

Some reason. So he went along and thought I'm gonna go and listen to this. Dress and he hears it and he's. Like you know what, mate? No, I don't. Agree with that, I need to do something. 

I went to the state of the Union. Nancy Pelosi made a terrible mistake by giving me her husband Paul's ticket to watch the state of the Union by George Bush. And I sat there slightly bewildered up in the audience listening to the issues of the day. Abstinence drug testing, steroid abuse. It ended with and the idea that indeed he was going to fulfil his private commitments now made public around a constitutional amendment to ban. And it occurred to me that, you know, at that moment that we had to respond as Mayor of San Francisco, I follow an obligation question was how. 

Yeah, he was triggered and San Francisco is the basically the gay capital of America. There is a lot of same sex couples in America that live in San Francisco. And I I love San Francisco is my favourite city in the United States of America. And The funny thing. Was when we went there on our. Honeymoon. And we, we noticed. Just there's a massive amount of dogs in San Francisco, more dogs than children in San Francisco, which is directly linked to same sex couples who obviously have pets instead of. 

More dogs than children. 

Children, which is. 

Essentially yes. 

Completely adorable, I think. And anyway, that's a side note, but obviously Newsome. Being the mayor of San Francisco. Being mindful of his constituents and the people that put him into power, there is at the state of the Union just gone, mate. Like, what are you talking about? No, I'm not OK with it. 

He's chief of staff, Steve Kayla, was. 

Carla. Steve, Carla, I think is. 

Steve Kawa is is gay and he calls up his chief of staff going. Hey, I've just listened to this address. Not cool. Ah, I reckon we should start issuing marriage licences to same sex couples because there was some loophole I don't fully understand it, but because he was mayor of San Francisco, which is both a city and a county that gave him some kind of authority that enabled him to be able to do that. So he's thinking. Just get it. Go for it. 

Yes. Shoot, Michelle, that's. Right, so to speak in and Bush's words, obviously in San Francisco didn't pass the pub test or the gay bar test. 

Too, it's just a month into his term as mayor, so that's pretty gutsy. A lot of people thought it could really hold him back and hold back the ability to accomplish what he wanted to as mayor and potentially destroy his political career. 

You asked what's the advice you'd give as a a newly elected mayor, they said. Well, do what you think is right. And then when you actually do what you thought was right, all of a sudden I said, wait a second. Hold on. Now you need to ask for permission and there's a process here and I'm straight and and and that's an issue that was an issue too. It's like, who gives this guy the right to be that advocate to see for us? And and the interesting thing, a lot of the members of the gay community, particularly the larger national organisations, they weren't ready for this fight. They weren't even thinking about this fight. I mean, remember, in 2004? 

To speak for us and set our agenda. 

We were barely entering into the debate around civil. Having gone through that half decade around domestic partnerships, gay marriage was never on the radar screen in the during the mayoral debates and the issues around who's the next mayor of San Francisco. So it was a it was a tough issue for a lot of folks. 

It was. I look, I don't know anything about his policies, really. I don't know all that much about Gavin Newsom at all, but to do that as a as a newly elected mayor is incredibly ballsy and and but also he also talks about how the community. 

Pretty bosses. 

Weren't too sure they weren't ready to have that kind of fight. They're like, can you just tone it down a little bit? I don't think we're ready for this and but I mean, he's. I mean he. He had he was of the belief that this was the right thing to do and to his credit as an elected official who is acting on behalf of his constituents. Has decided to stick his neck out and and do this. 

I think to. Some people had a problem with the fact that he became this face for marriage equality because I don't like he was saying that it wasn't even on. Radar through the campaigning, it wasn't one of his policies. It wasn't anything that. 

It it wasn't even a foundation for for yeah. 

He committed to. He's he's also straight and he's married and. 

But not the. Basis of him being elected at all. 

No, and he wasn't. He wasn't out. He didn't have a reputation for being outspoken. And I think that also Jarred a lot of people. I think people felt uncomfortable by that, but he saw the opportunity and he went for what he believed in. And I. 

Then it's like, whoa. 

He's the mayor of San Francisco. Like, hello, you know, I mean, hello. 

I think that's great. So look, hello on the 12th. Of February 2004. The city and County of San Francisco became the first government in the United States to grant marriage licences to same sex couples. They began issuing them, and Newsom asserted that the Constitution of California's equal protection clause gave him the authority to do so. The first couple to be issued A licence were lesbian. 

That's right. 

Activists del. Martin and Phyllis Lyme.

Do Udell take Phyllis to be your lawfully wedded? I now pronounce you. Great. Wonderful. 

After three days, city officials estimated that they had issued 900 same sex marriage certificates they'd assumed well, Newsome, 3 days 900. 

After three days, that's a that's a hell. The public service to be sitting there. They'd be getting RSI. 

Celeb celebrants would have made a Motza OK. 

Absolutely. Look, I can probably squeeze you in between 10:00 and 10:05, yeah. 

You some of these allies were quite surprised cause they assumed the courts would shut them down immediately, but the courts declined to intervene for nearly a month. They didn't halt the weddings until the 11th of March 2004. Unfortunately, the court later nullified those marriages. 

So it's almost like then that becomes a protest more than anything, yeah. 

That had been. Conformed yeah, he was chastised for not following the law as written with one justice saying that he had created a man. 

Well, I think he did, but I think he kind of did that on purpose, right? To put a pointer. Ross. He actually, it's it's very strange too, because like you said, like it wasn't in the campaign, it wasn't a foundation for his platform. Any of that sort of stuff. He's straight, but he then became this face for marriage equality across the country. And so all these news stories are like, hey, straight married, but. He wants same sex marriage to happen and I think that was because. Is he the reason why he became that face was because he didn't have that reputation? He wasn't this outspoken liberal that was able to kind of make this decision. But he did. Yeah. 

Umm. And yeah, a lot of gay rights activists weren't too happy with it because. It wasn't his lived experience, I think, and there are a lot of people who had, who had suffered over many, many years and they just felt. But he kind of made it all about him. 

So it it it it was. It isn't that interesting as well because it's obviously been perceived as a bit amongst that community as a bit of a misstep on his behalf. And I genuinely think and like I said, I don't know a lot about his policies or or even him as a person, but based on just the small amount of research that I've done, I think that he was doing it with the. The best of intentions. 

And Republicans, predictably, made him their enemy, and so he was a Democrat. Democrats cringed at how he's moved. Like, energise the conversations around well, cause the presidential election is coming up in 2004 as well, later in the year, yeah, so they were concerned about what sort of discussions might follow. 

And look, I I think maybe there's a couple of agendas at play as well. So he probably is not a fan of Bush based on the current political climate, the war and all of those things. He's the newly elected mayor of San Francisco, which has one of the biggest gay communities in the world. And he hears the state of the Union address. 

From their for their party. 

And the red mist comes in and the blinkers come on. And it's kind of like he can't hear anything else he's like, well, I'm gonna do that. You know how you get when people **** you off and you and you and you kind of just have almost that win at all costs attitude. I think that's kind of what's happening here and. 

For old Massachusetts, they've been working really hard to set the groundwork to be able to do something there. They were then concerned that all the work that they had done was in vain because. That would then put this motion forward by Bush or other rules in place that would then stop them from being able being able to to put it in. 

Place. So then you go to the 12th of August 2004 and the the California Supreme Court declares the marriages of thousands of same sex couples in San Francisco void. So they they've done the. That that you had that big influx of people as soon as he announces it. Happens and all the public servants in the celebrants are making lots of money and they working really hard and they do the marriages in May. And then finally, when we skip forward to August and we'll probably talk about this in a later episode as well, because it would have big news at the time they make it void. And they say that the mayor exceeds his authority by granting them marriage licences. 

The judges decided by A52 vote to nullify the 3995 gay marriages performed in the city between February 12 of March 11, when the courts finally halted the web. And the justice at the time said that they must wait until courts resolve the constitutionality of state laws that restrict marriages to opposite sex couples. The legal dispute led to a 2008 marriage cases ruling by the California Supreme Court. Which then legalised same sex marriage in California. So four years later. Hmm. Gee, you'd be annoyed if you got married in that 2004 window. Weddings are freaking expensive. 

Very are, but I. 

And to then have it cancelled out. I would be rightly ******. 

I maintain, you know, I I just well, yes, maybe. And I would be too, cause I was the bridezilla at our wedding. I I. 

Know this so much. Planning so much money, so much thinking things through, and it is a lot of effort I would. 

Be so annoyed, yes. But but I do think. That like for gay couples like weddings, would just. 

I mean that. 

Especially for gay blokes like weddings are just the business. Like you go to a bridal fair and I've said it before I went to the bridal Expo with you. And I'm like. Mate cake guys would love this. There's the champagne and the things and the decorations, and it all looks so gay. Weddings are gay. 

Do you know what I mean? Like it would. 

Have been wonderful. So I think that perhaps as to celebrate, they just do it all again. 

Why not? 

It would be wonderful. Alright, let's go over to some more scientific news. Because you know that homosexuality flies in the face of science. 

February 13, the Harvard Smithsonian Centre for Astrophysics discovers the Universal's largest known diamond white dwarf star BPM 37093, nicknamed Lucy. 

She's massive. She's a big girl, Lucy after. 

The discovery in 2004, astronomers decided to nickname the Space Diamond Lucy after The Beatles Song Lucy in the Sky with diamonds.

Scientists have found that approximately 90% of loses mass had crystallised, and since its interior core is mostly made of carbon, it means losing is the biggest diamond ever found. Well found. 

I mean through a telescope in space, but it's so the white dwarf that it is is like the hot cinder left behind when a star uses up all its nuclear fuel and dies, it kind of carbonised or whatever. So it's made up of carbon and oxygen, and it's surrounded by hydrogen and helium gases now. This particular one, Lucy, is 50 light years away from Earth. It's this, it's, and it pulsates. Did you know that? It's a pulsating white dwarf? I don't know. 

Oh, the salt, a pulsating diamond. 

Yes, which is odd, but I'm not sure what that means, but apparently it emits some kind of sound, which you probably couldn't hear in space because the vacuum anyway. Either I went to that bar in space and it was terrible. I had no. Atmosphere. Anyway, it weighed 5 million trillion trillion pounds. So that that would be 10 billion trillion trillion carats. Yeah, the the first thing that comes to mind with this is hip hop. 

Of diamonds? Yes. 

Hip hop well, diamonds. Imagine how. 

Ohh like ice around your neck, hmm? 

Yes, like imagine you know, I could just see some knob end in the hip hop community and you see them now, those dudes that are on TikTok and stuff and they got the grills in and then they've got the diamond tester. To prove that the crap that they've adorned themselves with is real. Ohh, really? Yeah. It's like because it's not enough to just have the fake diamonds they need to prove that they're real. 10 billion trillion trillion calories. Well, I mean we send and we tend to dominate with a bit of hip hop, but that's not our fault. It's just the Billboard charts. 

That is the sign of the times. That's what was happening in 2004. 

The Billboard charts are littered with hip hop. When's rock gonna come back into the fold? 

Well, you had Nickelback. Back in 2002, didn't. You what more do you want, Creed? 

I guess not. In the Billboard charts. Ohh crazy, I'm just a little wide open. Sorry I.

Hang on. So this is Kanye. When Kanye was OK for everyone to talk about, now it's like we can't talk about Kanye. 

When we were allowed to talk about family. But I know. Yeah, I don't know if we can. Or not.

I kind of yeah, I always have to think twice and. Go. Is it OK? To talk about him this way. 

Like he's quite mad. And I mean that. I don't wanna. I think he has some mental health issues. Yeah, but he's also.

He's pretty great. I don't like Kanye's use of these really high pitched. Samples, you know he's got the. 

Well, then you're not gonna like the. College chop house. 

Ohh no really. Like I like his rapping. I just don't like the samples that he uses. 

We've talked about it before. We've talked about him before, where he really wanted. 

He's now doctor Dre. I don't think he's even a medical student. 

Where he really wanted to become a rapper. But he had that car accident, his jaw wide shut. But even prior to that, nobody was interested in him as a rapper. He was. 

Ah yeah. 

Shopping around and because his style was very different from the more aggressive rap style of the time, he wasn't. He wasn't taken seriously. Yeah, and he was very preppy as well. He was very preppy, kind of clean cut sounding rap. So it. 

And he's quite an odd person. He's odd. Yeah, like Ralph Lauren rap. 

Was it was very yes. It was very different high.

So he turned to production. Remember? He's a he was a producer for Jay-Z and eventually signed a record deal in 99 with Rockefeller, which is Jay-Z, I think.

Yes. So he produced this album primarily himself and and this is this is the sample stuff that I'm talking about. So it has it. They called it chipmunk soul and I really hate it. Like I just, I I just think there's such good samples to use and and he he he. 

Why mess with the sample? 

Pitches up those vocals and then wraps over them. It's really weird, so he speeds them up and he pitches you some. He sounds. There's all these old school, classic R&B and Soul records that he uses. 

Makes them sound different, yeah. 

Are there any programmes, all his own drums and strings over the top, and he uses gospel and lots of different things. He's pulling into them. I think it's quite crowded and messy. I think I just there's there's a lot. I I understand why people like it. Well, like him and think that he's very talented. I think he's trying to do too much. He's over egged the pudding. 

Very experimental. Ohh, you think he's ever done? 

So to speak, yes, especially with the. 

It too many accessories. You should take off 10 accessories before walking out the door. 

**** *** the chipmunk soul mate. What are you doing? It's ridiculous. It's a novelty. It sounds like it. It sounds like an album that you buy for a child. 

You know, the album featured contributions from Jay-Z, Mos Def, Jamie Foxx. Obviously because of the song that's been it's been in the top five for a while now. 

Slow jams, yes. 

Slogans and Ludacris. Ludacris was on the college dropout, which I did not know. It was praised for his production. He's wrapping the balance of self examination and. 

Was he? 

Dream earned him several accolades, including nominations for Album of the Year and Best Rap Album at the 2000. 5 Grammy Awards. Obviously featured slow jams and the song that we've talked about before through the wire. 

In the same hospital with Biggie, Smalls died, that Doctor said. I have blood clots, but I ain't your naked man story on MTV and I ain't trying to make a band, I swear this right here. History in the making, man.

So this is a direct response to growing criticism of the NFL after Colin. And and his people began highlighting racial disparities amongst NFL's ownership and coaching. Right. So, you know, Kaepernick takes in the all this controversy comes up a lot of the white team owners are like, hey, man, like, just get out there and do what you paid to do. And everyone's like, whoa. And then Jay-Z gets involved. This is really interesting sound. Like, where? There's a press. I think it's like a press conference or something with Jay-Z is sitting here with Roger Goodell, the Commissioner of. NFL and it's not too long after the capping thing. It's in the same season. 

I think it's part of this partnership deal. I think that's when, yeah. 

Yeah. And like Jay-Z saying to everyone, I think we're all past taking a knee and the response, there was a lot of backlash against Jay-Z for that. So you sell out, mate. Like, what are you doing? You're sitting there with, like, I think the word Uncle Tom was bandied around, which I, I mean, I don't think I'm in any position to use that word.

And a lot of performers boycotted being part of the half time entertainment when all of that was happening. Rihanna was one example. So she's heavily criticised for performing at last year's Super Bowl after refusing to do so a few years earlier. Hush. 

Yeah, but then she agreed, and then they criticised her. Yeah. Well, a lot of people criticised because they thought a performance was garbage as well, you know. I mean, you had Doctor Dre and Snoop Dogg the year before, Rhianna as well, yeah.

Was what's interesting is since the capping thing, I think they had Lady Gaga did did a halftime show, and then there's.

I think that might have been a that might have been a different one, but what we've seen is we've seen, you know, Doctor Dre, Snoop Dogg, Rihanna. Usher like there's a lot of black artists that are now doing it. Posts all of that sort of stuff and I think it's been a few years. Like you'll say, I'd like Bruno Mars and Coldplay, and it was all very vanilla at a state. But then you had the weekend where everyone wanted the weekend to end and all of that stuff. So I don't know. I don't know if there's a connection there probably isn't. But a lot of these people that said that they weren't.

Going to support it then end up doing that and like it's a big ticket item like the exposure that you get from doing a halftime show is huge. 

And I think a lot of these artists are signed to his rock nation. Rock Nation is kind of, it's not just a label, it's a whole entertainment entity. It's some big conglomerate and.

He represents artists, he he he produces the albums, but he also represents them in his talent management and all kinds of things. So I think a lot of these artists are actually on the Rock Nation roster, so they're probably under contract to have to accept as well. They probably don't. I don't know if they get a lot of choice in the matter. 

Well the thing. With the Rihanna one that was interesting as well, in spite of the fact that she was criticised for saying that she wasn't gonna do it. And doing she did know when she was quite heavily pregnant as well, and it was quite suggestive. I didn't think it was too bad. I was waiting for the game to start again. If I'm being honest. 

I was waiting for other performance to come out with that one. I was surprised that it was just her, actually.
